Washington Consumer Health Data Rights

If you are a resident of the State of Washington, the My Health My Data Act (MHMDA) grants you special rights related to your consumer health data. This includes certain data we collect through your use of our Services, including:

• Baby’s respiration data

• Prematurity status

• Baby’s sensory data, such as sound, temperature, visual input, and environmental stimuli

This information may be classified as consumer health data under Washington law. Under MHMDA:

• We will not collect or process this data without your explicit, opt-in consent.

• You have the right to revoke consent at any time, without penalty.

• You may request access to, or deletion of, this data at any time by contacting us at support@mikucare.com.

We do not sell your consumer health data. We only use it for the limited purposes outlined in this policy—primarily to deliver, improve, and personalize our health monitoring services.

Add clarifying language for the three baby-specific categories:

Baby’s Health Data

Includes data actively collected by the Miku device or app for health monitoring purposes:

• Respiration rate

• Oxygen level detection (if applicable)

• Prematurity status

• Temperature, motion, or similar biologically sensitive information

This data is used only with your affirmative consent and is stored securely in compliance with applicable health data protection laws, including the MHMDA.

Baby’s Sensory Data

Includes environmental and sensory recordings used to inform device responses or features, such as:

• Audio or video recordings (e.g., baby’s sounds or visual motion alerts)

• Room temperature, humidity, or other environmental conditions impacting baby’s well-being

Baby’s Demographic Data

Includes data you voluntarily provide in setting up your profile:

• Date of birth / Age

• Gender

• Birth-related characteristics, such as weight or gestational status

Consent Model for Washington Residents

If you are a Washington State resident, you will be asked to explicitly opt in before we collect or process any consumer health data. This consent will be presented as a standalone agreement separate from our general Terms of Use or Privacy Policy.
