Care+ Terms of Service
Welcome to the Paid Services Page. This page describes our current Paid Services and contains the payment terms (“Payment Terms”) for each Subscription Level (defined below). By subscribing for a given Subscription Level, you agree to and accept all of the Payment Terms associated with that Subscription Level. The Payment Terms presented to you in the process of using or signing up for a Subscription Level are incorporated by reference into the Terms of Service, and form a binding contract between you (“User” and “you”) and Miku, Inc. (“Miku,” “we” and “us”). To the extent that the Payment Terms conflict with the Terms of Service, the Payment Terms will take precedence. For convenience and consistency, the definitions of any defined terms will be the same as those in the Terms of Service. Subscription Packages: Beginning on the “Effective Date” (the day on which you subscribe to the Service) and throughout the term of the Agreement, you shall pay Miku the monthly subscription fee, if any, for the level of service you have selected during the registration period (such fee, the “Subscription Fee,” and such level, the “Subscription Level”). The Subscription Fees for each Subscription Level are as follows:
Care+ 30: Care+ access and 30-day video storage - $9.99/month or $99/year
Care+ Unlimited: Care+ access and unlimited video storage - $19.99/month or $199/year
Video Storage: If you cancel or allow your subscription to end or fail to timely and fully pay fees, your extended video storage will cease and you will lose access to all stored videos that are older than 7 days. For Care+ 30, you will lose all access to all stored videos that are older than 30 days. During the first month after starting a Care+ 30 subscription, you will not initially see 30 days of videos. Videos will be added day by day until 30 days following the Effective Date. For Care+ Unlimited, videos will be added day by day and will remain available to you until your subscription ends.
Shared users: Subscriptions are per-device. Care+ access will be granted to the owner and any shared users with the correct permissions.
Factory Reset: If you remove a device from “your devices” and add that device back onto your profile, all Care+ data and videos will be deleted.
Miku reserves the right to change the Subscription Fees for any Subscription Level at any time upon thirty (30) days prior notice to you.
Refund Policy:Subscriptions can be canceled at any time with no early termination fees. You are entitled to a full refund within 7 days after the Effective Date. Cancellation outside of the refund window will result in auto-renewal being turned off: you will have access through the end of your last paid billing period and will not be billed again.
Miku has the sole right to decide whether you are in violation of any of the restrictions set forth in these Terms. Miku is free to suspend (or terminate) your access to the Services (or any part of the Services), for any reason in our discretion, including your breach of these Terms. In the event of termination, no refund will be provided.
Billing: On the Effective Date, and thereafter on each monthly “anniversary” thereof, Miku will charge the Subscription Fee for the following month to the credit card provided to Miku by you. Miku will send you a confirmation email receipt upon each credit card charge to the email address provided by you. All payments shall be made in U.S. Dollars. You will provide a valid credit card and an email address for charge receipts upon registration, and shall update such information from time to time as necessary to ensure that such information is at all times accurate. If the credit card information you have provided is incorrect or incomplete, or Miku is otherwise unable to complete a credit card transaction due to your error or omission, you shall pay a late fee on all amounts not paid at the rate of one and one-half percent (1.5%) per month or the maximum amount permitted by law, whichever is less. Your Paid Subscription will automatically renew until you decide to cancel it in your Miku user profile. At the time of renewal we will charge your selected Payment Method or another eligible payment method we have on file for you. If you wish to cancel your Paid Subscription, you should do so 24 hours before the day of auto-renewal. For yearly subscriptions, you will be charged on the same day and month that you initially subscribed.
Where legally required, Miku will notify you when the Paid Subscription is set to renew. You may change your credit card, address information or cancel your Paid Subscription before you are charged again by going to Your Memberships and Subscriptions.
Trial Periods: Miku may offer a one-time free trial or introductory offer during which you can try out the Service for free (“Free Trial Period”). You may be eligible for only one such free trial or introductory offer for any Subscription. If the Free Trial Period is available and you choose it, it will commence on the Effective Date, running until 0 days after the Effective Date. If you are participating in a Free Trial Period, you must cancel the Service by the end of the trial period to avoid incurring any charges. If you do not cancel the Service before the Free Trial Period expires, and we have informed you that the Service will automatically be converted into a Paid Subscription at the end of the Free Trial Period, then you authorize us to charge your credit card the applicable fees as indicated at the time you signed up for the Service. During the Free Trial Period, you agree that Miku will have the right (subject to applicable local law) to send you communications, notices and news about the Service. Local law may allow you to revoke your consent to receiving these communications at any time during the Free Trial Period. Miku reserves the right to modify, cancel and/or limit this Free Trial Period offer at any time.
